SiteScan™ Terms of Service

Terms of Use

By accessing or purchasing the SiteScan diagnostic verification service by Epik One, Inc., you acknowledge that you have read, understood and agree to be bound by the SiteScan Terms of Service. You may use SiteScan (the "Service") for use to scan website pages owned by you or otherwise under your management and control.  Please note that Google Analytics™ is the trademark of Google, Inc. and is not affiliated with SiteScan.  Google, Inc. accepts no responsibility, liability and does not provide support to individuals choosing to use this product.  All inquiries regarding SiteScan should be submitted to:  info@SiteScanGA.com

You shall not:

  1. use the Service to scan website pages that are not owned by you or otherwise under your management and control, unless you have received permission from the person or entity who owns or otherwise has management and control of such website page;
  2. use the Service to process or permit to be processed the data of a third party;
  3. except as specifically set out above, use the Service to publish, or provide to a third party, any scan results;
  4. alter, merge, adapt, modify, translate, or create derivative works based on the Service; or,
  5. access the Service with any automated software program unless you have been granted permission in written consent from Epik One, Inc.

No Additional Rights

You acknowledge and agree that except for the rights expressly granted above, all other right, title and interest in and to the Service, including any and all patent, trademark, copyright, trade secret, intellectual and industrial property rights remain the sole and exclusive property of SiteScan. You are not authorized to use the SiteScan  name or any of its trademarks in any manner whatsoever, absent prior written approval from EpikOne, Inc.

Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY OTHER REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING, OR OTHERWISE. SiteScan™ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR WITHOUT DELAY. YOU ASSUME THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SERVICE.  SiteScan™ SHALL NOT HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF SiteScan™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR THEY ARE FORESEEABLE. SiteScan™ IS NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. SiteScan™ MAXIMUM AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE US DOLLAR ($1 USD). THE LIMITATIONS IN THIS SECTION SHALL APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH. SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Payment, Refunds, Upgrading and Downgrading Terms for SiteScan Premium

  1. A valid credit card is required for payment of SiteScan Premium. You will be billed for your first month immediately upon sign-up.
  2. The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.  In order to treat everyone equally, no exceptions will be made.
  3. In the event that a monthly payment can not be billed due to an invalid credit card, your SiteScan Premium account will be suspended until payment is made.
  4. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
  5. Online or phone credit card purchases are processed in a secure environment and appear as "EpikOne, Inc." on your credit card statement. 
  6. For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle.

Cancellation and Termination

  1. You are solely responsible for properly canceling your SiteScan Premium account. If you wish to cancel, notify us in writing at info@SiteScanGA.com or prior to the 1st of the month billing period.  Your account will be valid until the end of the month you canceled.  After which time, you will no longer be able to access the account or stored reports.  SiteScan is not responsible for cancellation emails that do not reach us.  In the event you do not receive a response within 24 hours confirming your cancellation, it is recommended that you re-submit your request. 
  2. SiteScan, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other SiteScan service, for any reason at any time. Such termination of the Service will result in the deactivation of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. SiteScan reserves the right to refuse service to anyone for any reason at any time.

Modifications to the Service and Prices

  1. SiteScan reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  2. Prices of all Services, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the SiteScan Blog or in an notification email sent to customers.  
  3. SiteScan shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service

Modifications to Terms of Service

SiteScan™ reserves the right to update and change the Terms of Service from time to time without notice. Any new features or enhancements to the current Service shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
